Section – 84. Compulsory disclosure of information by occupier.

(1) The occupier of every factory involving a hazardous process shall disclose, in the manner prescribed by the State Government, all information regarding dangers, including health hazards and the measures to overcome such hazards arising from exposure to or handling of materials or substances in manufacture, transportation, storage and other processes, to the workers, the Chief Inspector-cum-Facilitator or Inspector-cum-Facilitator, the local authority and the general public in the vicinity.

(2) At the time of registering such factory, the occupier shall lay down a detailed health and safety policy for workers and intimate it to the Chief Inspector-cum-Facilitator or Inspector-cum-Facilitator and the local authority, and thereafter inform them of any changes at prescribed intervals.

(3) The information furnished shall include accurate details regarding quantity, specifications, characteristics of wastes and their disposal.

(4) The occupier shall, with approval of the Chief Inspector-cum-Facilitator, prepare an on-site emergency plan and disaster control measures and communicate safety measures to workers and the public in case of accidents.

(5) Where a factory proposes to engage in a hazardous process after commencement of this Code, the occupier shall inform the Chief Inspector-cum-Facilitator about the nature and details of the process at least thirty days prior, in the prescribed manner.

(6) If the occupier contravenes sub-section (5), the licence issued under section 79 shall be liable for cancellation, without prejudice to penalties under this Code.

(7) The occupier shall, with prior approval of the Chief Inspector-cum-Facilitator, lay down measures for handling, use, transport, storage and disposal of hazardous substances and publicise them among workers and the general public in the prescribed manner.
