Section – 41. Powers of special officer to enter, measure, etc., in relation to mine
Any person in the service of the Government, duly authorised by a special written order of the Chief Inspector-cum-Facilitator or an Inspector-cum-Facilitator, may, for the purpose of surveying, levelling or measuring any mine or its output, enter the mine after giving not less than three days’ notice to the manager. Such entry may be made at any time, by day or night, for carrying out the required survey, levelling or measurement.
Provided that where, in the opinion of the Chief Inspector-cum-Facilitator or Inspector-cum-Facilitator, an emergency exists, such authorised person may enter the mine without giving prior notice for the purposes mentioned above.
