Section – 23. Responsibility of employer for maintaining health, safety and working condition.

(1) The employer shall be responsible for maintaining in the establishment such health, safety and working conditions for employees as may be prescribed by the Central Government.

(2) Without prejudice to the generality of sub-section (1), the Central Government may prescribe provisions for all or any of the following matters in an establishment or class of establishments, namely:—
(i) cleanliness and hygiene;
(ii) ventilation, temperature and humidity;
(iii) an environment free from dust, noxious gases, fumes and other impurities;
(iv) adequate standards of humidification, including artificial increase of air humidity, ventilation and cooling in work rooms;
(v) supply of potable drinking water;
(vi) prevention of overcrowding and provision of sufficient space for employees or other persons employed therein;
(vii) adequate lighting;
(viii) sufficient and hygienic arrangements for latrine and urinal facilities separately for male, female and transgender employees;
(ix) effective arrangements for treatment of wastes and effluents; and
(x) any other arrangements considered appropriate by the Central Government.
