Section – 69. Exemption from provision regarding employment.
(1) In cases of emergency involving serious risk to the safety of a mine or persons employed, or in case of an accident (actual or apprehended), act of God, or urgent repair work due to breakdown of machinery, plant or equipment, the manager may, subject to clause (B) of sub-section (1) of section 38 and provisions relating to working hours and rest under sections 25, 26, 30 and 31, permit employment of persons in contravention of those provisions, to the extent necessary to safeguard the mine or its workers:
Provided that in case of urgent repair work, such action may be taken even if it incidentally affects mineral production, but it shall not exceed what is necessary to prevent serious disruption of normal operations.
(2) Every such instance shall be recorded along with the relevant circumstances, and a report shall be submitted to the Chief Inspector-cum-Facilitator or the Inspector-cum-Facilitator.
