Section – 35. Powers of Inspector-cum- Facilitators.
(1) Subject to rules made in this behalf, an Inspector-cum-Facilitator may—
(i) enter any workplace, with assistance from Government personnel, local authorities, or experts, where he believes work is being carried on;
(ii) inspect and examine the establishment, premises, plant, machinery, articles, or any relevant material;
(iii) inquire into any accident or dangerous occurrence, whether or not it resulted in injury, disability or death, and record statements of relevant persons;
(iv) examine crops in plantations, workers employed therein, or require production of registers and documents, and record statements as necessary;
(v) provide information and create awareness among employers and workers regarding compliance with this Code;
(vi) require production of registers or documents related to workplace or work activity;
(vii) search, seize, or take copies of registers, records or documents related to any suspected offence under this Code;
(viii) direct that any premises or part thereof, or anything within, remain undisturbed for inspection or inquiry purposes;
(ix) take measurements, photographs, videographs, or other recordings for examination or inquiry;
(x) take samples of substances, articles, or air from any workplace or its vicinity in the prescribed manner;
(xi) in case of hazardous articles or substances, order dismantling or testing, take possession, or detain such items for examination if necessary;
(xii) issue show-cause notices relating to safety, health and welfare provisions under this Code;
(xiii) prosecute, conduct or defend legal proceedings arising under this Code; and
(xiv) exercise other prescribed powers and duties.
(2) Any person required to produce documents or provide information under sub-section (1) shall be legally bound to do so under sections 175 and 176 of the Indian Penal Code.
(3) The provisions of the Code of Criminal Procedure, 1973 shall, as far as applicable, apply to searches and seizures under this section as they apply to those conducted under a warrant issued under section 94 of that Code.
