Section – 16. National Occupational Safety and Health Advisory Board
(1) The Central Government shall, by notification, establish the National Occupational Safety and Health Advisory Board (referred to in this Code as the National Board) to perform the functions assigned under this Code and to advise the Central Government on matters relating to—
(a) formulation of standards, rules and regulations under this Code;
(b) implementation of the provisions of this Code along with the related standards, rules and regulations;
(c) policy and programme issues concerning occupational safety and health as referred by the Central Government from time to time; and
(d) any other matter under this Code referred to it by the Central Government from time to time.
(2) The National Board shall comprise—
(a) Secretary, Ministry of Labour and Employment — Chairperson (ex officio);
(b) Director General, Factory Advice Service and Labour Institutes, Mumbai — Member (ex officio);
(c) Director General, Mines Safety, Dhanbad — Member (ex officio);
(d) Chief Controller of Explosives, Nagpur — Member (ex officio);
(e) Chairman, Central Pollution Control Board, New Delhi — Member (ex officio);
(f) Chief Labour Commissioner (Central), New Delhi — Member (ex officio);
(g) Principal Secretaries handling labour matters from four States (on rotation as decided by the Central Government) — Member (ex officio);
(h) Director General, Employees’ State Insurance Corporation, New Delhi — Member (ex officio);
(i) Director General, Health Services, New Delhi — Member (ex officio);
(j) five representatives of employers — Member (ex officio);
(k) five representatives of employees — Member (ex officio);
(l) one representative from a professional body related to the subject for which standards, rules or policies are being framed — Member;
(m) five eminent persons from the field of Occupational Safety and Health or representatives from reputed research institutions or similar disciplines — Member;
(n) special invitees from State Governments or Union Territories for inputs on specific matters, industries or sectors predominant in that region — Member;
(o) Joint Secretary, Ministry of Labour and Employment — Member Secretary (ex officio).
(3) The members referred to in clauses (g), (j), (k), (l) and (m) of sub-section (2) shall hold office for a term of three years, and their nomination process and functions shall be as prescribed by the Central Government.
(4) The Central Government may, in consultation with the National Board, decide the number, nature and categories of officers and employees required to assist the Board. Their service conditions shall be prescribed by the Central Government.
(5) The Central Government may constitute technical or advisory committees, consisting of members with prescribed qualifications, to assist the National Board in carrying out its functions under sub-section (1).
(6) The National Board shall consult the State Governments whose Principal Secretaries are members under clause (g) of sub-section (2), and for specific issues relating to plantations, factories or similar sectors, the concerned State Government may be invited as a special invitee to provide inputs.
